Start your business off right, and avoid legal hassle down the road by taking care of a few details right away.

Research your business name

A rose by any other name will smell as sweet, as long as no on else is already using the name. In Indianapolis, you can perform an online name search through the office of the Secretary of State.  This will tell you if the name is available locally.

Choose an organizational structure
The general types of business entities are sole proprietorships, corporations, partnerships and limited liability companies. Choosing the correct organizational structure for your business is vital because it will dictate how your business will be operated and taxed.

File the legal paperwork with the state
Business entities exist under state and local law, not federal law. The type of entity you choose to operate will determine what type of paperwork is required.  In Indiana, this can be filed on-line.

Obtain an employer identification number from the IRS.
Your new business will need to obtain an employer identification number (EIN). This number will be used by both the IRS and state agencies to identify your business.
